Hey Daniel Thanks for the great comment, I agree with you it would be good to see what an ip lawyer would say on the matter, I'm no lawyer so can't say I could comment but if there is anyone out there who is then please get your opinion up here.

What do you do Daniel seems you know quite a bit about this subject.

Cloning sites is a very interesting topic. I am not an expert, but there is also the issue of Intellectual Property for web businesses and how to protect this which is just as interesting.

Cloning in itself I don't think is illegal. Many clone sites are not a threat as they do not know how to implement the business or do not have the market know-how and critical mass to make the business work. Looking at Shiply and Uship, the former does appear to be a blatant clone of Uship. So what happens when a clone is successful and wins awards from judges who are none the wiser. Is this unethical or just business?

Uship may have the right to feel disgruntled in this respect, as it does appear to be a like for like clone, however I don't believe it is illegal to do so. Just unimaginative and basic.

Would be interesting to see what an IP Lawyer would make of it. Uship should probably have trademarked their logo and name in Europe as a strategy and then could maybe have challenged Shiply in terms of their logo and what they are doing under the trade name in Europe? Is there a lawyer in the house to answer?

Fred,

Clearly you've researched this, I had a look at the two sites side by side and there is shocking similarities. I'm hoping to meet the guys from Shiply next week and if I can I'll try to pose this question to them. I still stand by what I said before but then who am I to tell you what to do?

I don't know the full story but I think you can go out and crush it no matter, you should only be worried or annoyed about it if you think they're better than you and if you do think that work out how to put that right. Anyway isn't it a great compliment to the Uship idea if they did copy you?

In the meantime I plan to write a post about this in the next few days, if you can send me an email (oli @ oligibson.com) it would be good to add your comments and I also hope to get some response from Shiply.

Thanks for your comments its definitely an interesting subject.

Oli,
Maybe so, but look at how they exactly copied the design - even the logo is very similar. The searching page is an exact ripoff. Whats quite funny is Shiply's story about how he came up with the idea. Its exactly the same as the uship story.

I'll agree they are very similar services but I don't think that means they can't win an award, Uship is serving the American market and the Shiply the british market. Look at Lovefilm in the UK and Netflix in the US both are great companies in their own right even if their business is basically the same. Maybe one copied the other, they probably did but you need to look deeper than that, it's not necessarily the original idea for a product or service that makes a company, normally it's the implementation that is the differentiator.

Shiply is a brutal clone of uship - they even stole the look of the site and it looks like some of the html maybe. How does nobody look that up when giving an award for a great idea.

Brighton is a fantastic city; having grown up just north of the area I used to go there all the time. Such a diverse mix of people make it what it is. The fact that it is also a city by the sea makes it easy enough to escape and relax on the beach!

The Shell Livewire awards look good. I was invited to attend but sadly I can't make it. No doubt it will be a great event!
